1. Acceptance of Terms

By accessing and using Unspun.Studio ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform.

2. Digital Products

All patterns sold on the Platform are digital downloads. Once a purchase is completed and the file has been downloaded, it cannot be returned or exchanged. Please review pattern details carefully before purchasing.

3. Intellectual Property

Patterns sold through the Platform are the intellectual property of their respective designers. Purchasing a pattern grants you a personal, non-commercial licence to use the pattern. You may not resell, redistribute, or claim ownership of any purchased pattern.

4. Designer Ownership & Data Rights

We believe designers should be in full control of their business. This principle is at the core of how the Platform works:

  • Your files are yours. Any pattern files, images, or content you upload remain entirely your property. The Platform stores them on your behalf to facilitate sales but claims no ownership, licence, or rights over your creative work beyond what is necessary to operate the service.
  • Your customers are yours. Buyers who purchase your patterns are your customers - not ours. Their contact details, purchase history, and any relationship built through the Platform belong to you as the designer. We facilitate the transaction; we do not own the customer relationship.
  • Your subscriber list is yours. Any email subscribers you collect through the Platform's newsletter tools belong to you. You can export your list at any time. We will never contact your subscribers on our own behalf or share their details with third parties.
  • You can leave at any time. If you decide to close your account, you can export your customer data, subscriber list, and sales history before doing so. We will not hold your data hostage or make it difficult to move on.

The Platform operates as a facilitation layer - we provide the tools, infrastructure, and marketplace. You provide the creativity and the community. That distinction matters to us.

5. Designer Responsibilities

Designers listing patterns on the Platform are solely responsible for the accuracy, quality, and legality of their content. The Platform acts as a marketplace and does not endorse or guarantee any specific pattern.

6. Payments & Fees

All transactions are processed securely through PayPal. Prices are shown in the designer's listed currency.

How the money flows: When a buyer completes a purchase, payment goes directly to the designer's PayPal account at the time of sale. The Platform does not hold or pass through funds on behalf of designers.

Platform fee: The Platform charges a percentage-based fee on each sale. Rather than deducting this at the point of transaction, fees are accumulated and invoiced to designers on a bi-weekly basis. Upon receiving a fee statement, designers have 7 days to settle the amount. Continued use of the Platform constitutes agreement to pay outstanding fees when due.

Fee rates: The applicable fee rate is shown in your designer dashboard and on the Platform's pricing page. Rates decrease as your monthly sales volume grows. Any changes to fee rates will be communicated in advance.

Non-payment: If a fee invoice remains unpaid beyond the payment window, the Platform reserves the right to temporarily suspend the designer's storefront until the outstanding balance is settled.

Tax: As of 1 June 2026, the Platform does not collect, calculate, or remit taxes (including VAT, GST, or sales tax) on behalf of designers or buyers. Designers are solely responsible for determining and meeting their own tax obligations in their jurisdiction. We are actively working on a managed tax solution through a merchant of record partnership and will update these Terms when that becomes available.

7. Prohibited Content — AI-Generated Patterns

Unspun.Studio is a marketplace built exclusively for human-made creative work. The following are strictly prohibited:

  • AI-generated patterns - patterns produced in whole or in significant part by artificial intelligence tools, image generators, or automated design systems may not be listed on the Platform, regardless of how they are described or presented.
  • Misrepresentation - presenting AI-generated content as human-made is a serious breach of these Terms and of the trust buyers place in designers on this Platform.

We actively review content for AI indicators. If a pattern is found or reasonably suspected to be AI-generated, we reserve the right to remove it immediately and without notice, suspend or permanently terminate the designer's account, and notify affected buyers. We do not offer appeals for clear violations.

By listing on the Platform, designers confirm that their patterns are their own original, human-created work.

8. Prohibited Content — Piracy & Stolen Patterns

Listing patterns that you do not own the rights to is strictly prohibited. This includes:

  • Patterns copied, traced, or adapted from another designer's work without explicit permission.
  • Patterns purchased from another designer and resold as your own.
  • Patterns that are substantially similar to existing copyrighted works.

If a pattern is reported and found to infringe on another creator's intellectual property, we will remove it immediately and cooperate with the rights holder. Repeat offenders will be permanently banned from the Platform. Designers who believe their work has been stolen may contact our support team with evidence and we will investigate promptly.

Buyers are also prohibited from redistributing, sharing, or reselling purchased patterns. Doing so is a breach of these Terms and may constitute copyright infringement.

9. Age Requirement

You must be at least 18 years of age to create a designer account, list patterns, or receive payments through the Platform. By registering as a designer, you confirm that you meet this requirement. Buyer accounts may be created by users under 18, but purchases may not be made without parental or guardian consent where required by local law.

10. Third-Party Services

The Platform relies on third-party services including PayPal (payment processing), Amazon Web Services (file storage and delivery), and email service providers. By using the Platform, you acknowledge that these providers have their own terms and policies which apply independently of ours. We are not responsible for outages, policy changes, or decisions made by third-party providers that affect your use of the Platform.

11. Platform Availability

The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access or uptime. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary unavailability. We will endeavour to communicate planned downtime in advance where possible but accept no liability for losses arising from service interruptions.

12. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, list prohibited content, or otherwise misuse the Platform. Where possible, we will notify affected users before taking action, except in cases of serious or urgent violations.

13. Limitation of Liability

The Platform is provided without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to loss of sales, loss of data, or damage to your business reputation.

14. Changes to Terms

We may update these Terms from time to time. We will notify designers of material changes via email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa, without prejudice to any right you may have to bring proceedings in another jurisdiction where required by applicable law.

16. Buyer Accounts & Platform Access

While designers own their customer relationships and data as described above, buyer accounts on the Platform are registered with and managed by Unspun.Studio. This means:

  • Buyer accounts, login credentials, and access to the Platform are governed by us, not by individual designers.
  • We are responsible for account security, authentication, and buyer-facing support on the Platform.
  • We reserve the right to suspend or terminate buyer accounts that violate these Terms, engage in fraud, or misuse the Platform — including unauthorised sharing or redistribution of purchased patterns.
  • Buyers' purchase history and download access are stored and managed by the Platform to ensure they can access their purchases at any time, regardless of changes to a designer's account.

In short: the customer relationship belongs to the designer, but the buyer's account on the Platform belongs to the Platform. Both parties benefit from this arrangement.
